Terms of Use — NetBlade

These terms govern the use of the NetBlade app (package com.netblade.tools) for Android and iOS. By installing or using the app you accept them. The agreement is between you and Innovatek: the App Store and Google Play distribute the app, but they are not a party to it.
Who provides the app
NetBlade is developed and published by Innovatek di Cafaro Carmelina, VAT IT06424410659, info@innovateksoftware.com. The terms of the store you downloaded the app from apply in addition to these; on purchases, refunds and the store's own usage rules, theirs prevail.
Licence
We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use NetBlade on the devices you own or control, within the usage rules of the store you downloaded it from, including those on family sharing. The app is licensed to you, not sold. You may not resell, rent, redistribute or decompile it, or attempt to derive its source code, except to the extent the law does not allow that restriction.
Permitted use and your responsibility
NetBlade is a diagnostic tool: it finds devices, open ports, services and configuration weaknesses. Use it only on networks and equipment you own or have explicit authorisation for. Scanning someone else's network, reaching devices with credentials that are not yours, or using the app to work around security measures may be a civil or criminal offence in your country, and the responsibility is entirely yours. You are also responsible for the credentials you enter in the app (SNMP, SSH, Windows) and for the consequences of the operations you start on your own equipment.
Free version
The core of NetBlade is free on both platforms: network scan, device list, ports, ping, traceroute, DNS, speed test, network score and the map. On Android the free version is funded by advertising (Google AdMob), and ads can be removed with a one-time purchase. On iOS there is no advertising: the professional features are gathered in the NetBlade Pro subscription.
NetBlade Pro subscription (iOS)
NetBlade Pro unlocks the Windows and Linux inventories, the vulnerability check, exports and the PDF report, ThreatScan, the router security check, SSH, file transfer, the monitors, hostile-network analysis, domain reconnaissance, unlimited saved networks with their history, and backup. It is available monthly (€1.99 in Italy) or yearly (€9.99 in Italy); in every other country the price is the one the App Store shows you, in your currency, before the purchase. A period lasts one month or one year, according to the plan you choose.
Auto-renewal, free trial and cancellation
The subscription renews automatically at the same price at the end of each period unless cancelled. Your Apple Account is charged when you confirm the purchase and then within the 24 hours before the end of each period. New subscribers are offered a 3-day free trial, once per Apple Account: if you do not cancel before the trial ends, the subscription continues as a paid one; any unused part of the trial is forfeited if you buy the subscription before it expires. You can cancel at any time in Settings › your name › Subscriptions on the device, at least 24 hours before renewal: cancellation takes effect at the end of the period you have already paid for, which stays usable to its last day. If a payment fails, Apple may grant a 3-day grace period during which the subscription stays active while the payment is retried.
Payments and refunds
Every purchase is handled by the store: Apple on iOS, Google on Android. Payment is processed entirely by them, and Innovatek never receives or stores payment data. Refunds must also be requested from the store, through its own process (reportaproblem.apple.com for Apple, Google Play support for Android): we have no technical way to issue them. If you are a consumer in the European Union, the withdrawal rights the law gives you are honoured by the store you bought from. A subscription applies to the store it was bought in: an iOS subscription does not unlock the app on Android, and vice versa.
Support and updates
Support for NetBlade is provided solely by Innovatek, at info@innovateksoftware.com; Apple and Google have no maintenance or support obligation for the app. We publish updates when there is reason to, but we do not promise a frequency, nor that any single feature will stay available: some depend on third-party services or on operating-system capabilities that can change.
Warranties
NetBlade is provided "as is". To the extent the law allows, we make no warranty that it is free of errors, that the service is uninterrupted, or that it fits a particular purpose. What a scan reports — names, vendors, flagged vulnerabilities, the network map — are indications derived from network protocols and public sources, to be verified before you make a decision that matters. If the app fails to conform to an applicable warranty and you downloaded it from the App Store, you may notify Apple, which may refund the purchase price; beyond that, to the maximum extent permitted by law, Apple has no other warranty obligation. Consumers' statutory rights are unaffected.
Limitation of liability
To the extent the law allows, Innovatek is not liable for indirect damages, loss of data, business interruption, or damage arising from operations you carry out on your own equipment through the app. Nothing in these terms limits liability for wilful misconduct, gross negligence or personal injury, nor consumers' non-waivable rights.
Claims and third-party rights
Innovatek is responsible for handling claims relating to NetBlade — product conformity, legal obligations, consumer protection — and any third-party claim that the app infringes their intellectual property rights. Apple and Google are not responsible for such claims. The app's code, graphics and trademarks belong to Innovatek or to their respective owners.
Compliance and export restrictions
By using the app you represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any prohibited or restricted party list. You agree to use NetBlade in compliance with applicable law, including software export law.
Apple as third-party beneficiary
For the iOS version, Apple and its subsidiaries are third-party beneficiaries of these terms: by accepting them, you agree that Apple has the right to enforce them against you as a third-party beneficiary.
Changes
We may update these terms, for instance when the app's features or the stores' rules change. The version in force is always the one published on this page, with the update date at the top. A price increase on a running subscription requires your explicit consent under Apple's rules: without consent, the subscription simply does not renew.
Privacy
How data is handled is described in the NetBlade Privacy Policy, which forms an integral part of these terms.
Governing law and disputes
These terms are governed by Italian law. If you are a consumer, the mandatory rules of your country of residence and the jurisdiction of the courts where you live still apply, and you may turn to the alternative dispute resolution bodies available under your own legal system.
